Convention for the Protection of Cultural Property in the Event of Armed Conflict (1954 Hague Convention) — core principles summary

The 1954 Hague Convention was adopted at The Hague under UNESCO and is the first and most comprehensive multilateral treaty dedicated exclusively to protecting cultural heritage in wartime. Its moral premise is stated in its own preamble: any damage to cultural property, irrespective of the people it belongs to, is a damage to the cultural heritage of all humanity, because every people contributes to the world's culture. That premise does specific work. The Convention treats monuments, archaeological sites, art, manuscripts and scientific collections as worth protecting regardless of whose territory they sit in or who owns them, which is an explicit rejection of destroying an enemy's heritage as a legitimate act of war. Heritage is placed outside the set of things a belligerent may treat as the other side's property. Protection is a standing obligation rather than a wartime improvisation. States commit to preventive measures in peacetime: inventories, emergency plans against fire or building collapse, and plans for moving cultural property to safety. Preparation has to happen before the war arrives, because it cannot be done once it has. On the conduct of hostilities the Convention imposes affirmative restraint, not only a prohibition on looting after the fact. States commit not to use cultural property in ways that expose it to destruction, and to refrain from any act of hostility directed against it. Property of very high importance can be registered for special protection and marked with the Convention's distinctive emblem, so that combatants have a visible and unambiguous signal of what must not be targeted. The Convention also treats this as a matter of military discipline rather than diplomacy alone. States are asked to establish special units within their armed forces specifically responsible for protecting cultural property, and to set real sanctions for breaches.
