Terms & Conditions

Article 1 – Identity of the Company

 

The website www.symbioticdesignacademy.com (hereinafter: "the Website") and the Symbiotic Design Academy (hereinafter: "the Academy") are operated by:

Article 2 – Applicability and Age Restriction

 

2.1. These Terms and Conditions apply to every offer made by Symbiotic Design and to every distance contract concluded between the Company and the User.

2.2. Age Requirement: The services, books, and courses offered by the Academy are intended exclusively for individuals aged 18 years or older. By creating an account or making a purchase, the User warrants that they meet this age requirement.

2.3. Before the distance contract is concluded, the text of these Terms and Conditions will be made available to the User.

 

Article 3 – Payment Processing and Financial Data

 

3.1. All financial transactions are conducted via the Wix Payments platform.

 

3.2. Symbiotic Design does not store, process, or have access to any sensitive financial data, such as full credit card numbers or bank account details. All such data is handled securely by Wix.com in compliance with PCI-DSS standards.

3.3. By making a purchase, the User agrees to the processing of their payment via Wix Payments.

Article 4 – Physical Products (Printed Books)

 

4.1. Third-Party Fulfillment: Printed books are manufactured and shipped by Lulu.com.

4.2. Liability: While Lulu.com handles logistics, Symbiotic Design remains legally responsible for the conformity of the product. If a product is defective or lost in transit, the User must contact the Academy within 30 days to arrange a replacement.

4.3. Right of Withdrawal: In accordance with EU law, the User has 14 days from the date of receipt to withdraw from the purchase of a physical book.

4.4. Return Procedure: As there is no automated "Withdrawal Button" for physical goods on the platform, the User must notify the Academy via email. The User is responsible for the direct cost of return shipping.

 

Article 5 – Digital Products (Web Experience & Online Courses)

 

5.1. Definition of Service: The Academy provides "Web Experience" books and online courses as Digital Consumables.

5.2. Access Duration: Digital purchases grant a license for one (1) year (365 days) from the date of purchase.

5.3. The 20% Consumption Rule: In accordance with Art. 6:230p of the Dutch Civil Code, the right of withdrawal is waived once the performance has begun with the User’s consent. The Academy defines the "start of performance" as the point where the User has accessed more than 20% of the digital content (chapters, modules, or interactive elements).

5.4. No Refund Policy: If the User has consumed more than 20% of the content, or if 14 days have passed since the purchase, no refund will be issued.

5.5. Accessibility: The Academy is 100% responsible for the digital infrastructure of the Web Experience. This includes an integrated audio version and features allowing for text enlargement for disability access.

5.6. Continuity Guarantee: If the Academy platform closes or access is revoked before the expiration of the User's one-year license, the Academy will provide a permanent PDF version of the content as a final delivery.

 

Article 6 – Online Subscriptions

 

6.1. For recurring subscription services, the Academy provides an automated Cancellation Button within the User’s account settings.

 

6.2. Cancellation stops future billing cycles but does not grant a refund for the current cycle if the 20% consumption threshold (as defined in Art. 5.3) has been met.

 

Article 7 – Events, Workshops, and Talks

 

7.1. This article applies to both online and in-person events.

.2. Cancellation by User:

  • Full refund if cancelled more than 14 days before the event.

  • 50% refund if cancelled between 7 and 14 days before the event.

  • No refund if cancelled less than 7 days before the event.
    7.3. Cancellation by Academy: If an event is cancelled by the Academy, the User will receive a 100% refund of the ticket price. The Academy is not liable for associated travel or accommodation costs.

 

Article 8 – Intellectual Property

 

8.1. All content provided by the Academy, including the Symbiotic Design methodology, text, audio, and visual materials, is the intellectual property of Symbiotic Design unless explicitly mentioned.

 

8.2. Use of these materials is restricted to personal, non-commercial education. Unauthorized reproduction or distribution is strictly prohibited.

 

Article 9 – Governing Law and Disputes

 

9.1. Contracts between the Academy and the User are governed exclusively by Dutch Law.

 

9.2. Any disputes shall be submitted to the competent court in the district of East Brabant (Eindhoven), the Netherlands.
